Undocumented immigrants in the United States have several rights under the U.S. Constitution. Here are some key rights:
Right to Due Process: The Fifth and Fourteenth Amendments guarantee that no person shall be deprived of life, liberty, or property without due process of law. This means undocumented immigrants have the right to a fair legal process in civil, criminal, and immigration matters
Right to Equal Protection: The Fourteenth Amendment ensures that no state shall deny any person within its jurisdiction the equal protection of the laws. This applies to undocumented immigrants as well
Right to Remain Silent: Undocumented immigrants have the right to remain silent and not answer questions from immigration officers or police
Right to Legal Representation: While undocumented immigrants do not have the right to a government-appointed attorney in immigration proceedings, they can hire an attorney to represent them
Right to Education: Undocumented children have the right to attend public schools from kindergarten through 12th grade
Right to Work: While undocumented immigrants do not have the legal right to work in the U.S., they are protected by labor laws, including the right to be paid for their work and to work in safe conditions
Right to Emergency Medical Care: Undocumented immigrants have the right to receive emergency medical care regardless of their immigration status
